Two months after the MyData plan was closed to public negotiation, the Greek Tax Administration (IAPR) has yet to share feedback from the business community on the proposed plan and has not made any formal announcement on the issue.

However, local negotiations suggest that the Greek Tax Administration may bring back the electronic billing application proposed in August 2018, based on the Clearance model.

According to information from stakeholders, the Greek Tax Administration will impose an e-invoice obligation to reduce administrative burdens on businesses and prevent tax evasion.

However, the exceptional circumstances contained in the European Union Tax Regulation will remain valid, and the Greek Tax Agency will adapt to the exceptional circumstances relating to the implementation and special billing methods contained in the regulation.

First steps

Defining the scope of official duties of service providers will be the first step in dealing with the implementation of e-billing.

the current role of service providers under myDATA consists of the functions of preparing, consolidating and transmitting data to the state portal for taxpayers, and government oversight is not much needed.

In cases where the role of service providers is extended, the functions at the heart of the tax audit under normal circumstances, such as the release of invoices by various means, may also be included in the process.

A model of function that is not regulated and not subject to supervision, it is an ibra model similar to that in India.

In this model, the scope of liability of the service provider covers functions such as verification of the reference number on the invoice, corresponding to verification of the relevant reference number, called MARK, in the myDATA plan of Greek legislation.

The scenario in which the functions of service providers are extended is a function that is often restrictive and regulated, subject to the eligibility criteria of the state. Accordingly, service providers will act as a Pac-like official agency in Mexico that performs the bill ibra function provided by the state from outside.

It remains unclear, of course, which path Greece will choose at this crossroads on ibra.

According to the implementation plan, the myDATA project is expected to be delayed by 3 months so that authorities can complete the accreditation plan for e-billing service providers by early 2020.

The projected new launch date for the MyDATA plan is April 1, 2020.
